Terms of Service

Effective date: September 22, 2026

1. Agreement

These Terms of Service govern your use of the My Garden website, apps, and related features (the “service”). By signing in or using the service, you agree to these Terms. If you do not agree, do not use the service. Our Privacy Policy explains how we handle your information.

2. Accounts

You must be old enough to form a binding agreement where you live, and at least 13 years old, to use the service. You sign in with a Google account and are responsible for activity under your account. Keep your sign-in secure and tell us promptly if you believe your account has been misused.

We may require approval before an account can use private garden features, and we may limit, suspend, or remove access to protect gardeners, the service, or our providers.

3. Your content

You keep ownership of the photos, notes, names, and other content you add. You give us a non-exclusive, worldwide, royalty-free license to host, store, process, display, and transmit that content only as needed to operate and improve the service, including sending it to the AI providers described in the Privacy Policy when you use AI features.

Your garden is private by default. When you share a plant with Community, its public details, selected photos, public note, plant name, and your community nickname can be seen by anyone, including people who are not signed in. When you invite a caretaker, that person can see the plant details allowed by the permission you choose.

If you edit an AI-drafted care guide for a new species, that guide may be reused as the shared reference for other gardeners who add the same species.

4. Community rules

You agree not to use the service to:

  • Post sexual, hateful, harassing, threatening, violent, or otherwise inappropriate content.
  • Share other people's private information, or photos you do not have the right to share.
  • Impersonate others, including My Garden staff, or mislead people about who you are.
  • Advertise, spam, or solicit other gardeners.
  • Break the law or encourage others to cause harm.
  • Probe, scrape, overload, or interfere with the service, get around usage limits or safety checks, or access data that is not yours.

Photos, community notes, nicknames, and new care guides are checked automatically before they are published, and may also be reviewed by people. We may decline, hide, or remove content and suspend accounts that break these rules. You can block or report other gardeners in the app.

5. AI features are guidance, not professional advice

Plant identification, care guides, toxicity information, and visible-health reports are generated with the help of AI. They can be incomplete or wrong, and a photo can't show everything about a plant. Treat them as general information and use your own judgment before acting on them.

Nothing in the service is medical, veterinary, or professional horticultural advice. If a person or animal may have eaten a plant, contact a poison control center, a doctor, or a veterinarian right away. Always follow the label when using any garden product.

6. Usage limits and availability

To keep the service reliable and affordable, AI features and some other actions have hourly and daily limits per account. We may change limits, features, or AI providers over time. The service may occasionally be unavailable for maintenance or because of problems with our providers.

7. Product links and fees

Some care suggestions link to products sold by other companies. Some of these links may be sponsored or may earn us a commission. We don't control those products or sellers, and their terms apply to any purchase.

The service is currently free. If we introduce paid features, we will show you the price and any additional terms before you are charged.

8. Ending your use

You can stop using the service at any time and delete your account from your Profile. Deleting your account removes your private garden data and uploaded photos as described in the Privacy Policy. We may suspend or end your access if you break these Terms or if we stop offering the service.

9. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee any plant's health or survival.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost plants, data, or profits, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don't allow these limits, so they may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

11. Changes to these Terms

We may update these Terms as the service changes. We will post the new version here and update the effective date. If a change is significant, we will give notice in the app or by email before it takes effect. Continuing to use the service after the change means you accept the updated Terms.
